Kwickly Terms & Conditions

These Terms & Conditions govern access to and use of the Kwickly mobile application, website, task posting system, task broadcast system, messaging tools, payment features, verification tools, notifications, reviews, and related services.

Kwickly is operated by My paws International LDA, NIPC 518562530, with registered address at Av. Dom João Ii Nr. 98 A 1990-100 - LISBOA, email Support@kwickly.app, website www. Kwickly.app.

1. Acceptance of Terms

By creating an account, posting a task, accepting a task, making a payment, receiving a payout, messaging another user, uploading content or otherwise using Kwickly, you agree to these Terms. If you do not agree, you must not use Kwickly.

2. What Kwickly Is

Kwickly is a technology platform and real-time local help network. It connects Task Posters who need help with nearby independent Task Doers who may accept and perform tasks. Kwickly does not itself provide cleaning, moving, delivery, handyman, photography, translation, tutoring, design, IT, car washing, property assistance or any other services listed in the app. When a Task Poster selects a Task Doer for a task, the service contract for that task is formed directly between the Task Poster and the Task Doer. Kwickly is not a party to that service contract, does not provide the underlying service, and does not employ, supervise, or control the Task Doer. Kwickly acts only as an intermediary technology platform that facilitates task posting, matching, communication, payments, reviews, dispute support, and related platform tools.

3. Intermediary Role

Kwickly provides technology tools such as task posting, task broadcast, matching, chat, notifications, profile display, reviews, payment facilitation, verification tools, dispute support and admin moderation. Kwickly is not a party to the underlying service contract between users except for its own platform services.

4. User Types

A Task Poster is a user who posts a task and requests help. A Task Doer is an independent individual, freelancer, selfemployed person, professional or company that accepts and performs tasks. A user may act as both Task Poster and Task Doer using the same account and can switch between roles using Switch functionality.

5. Eligibility

Users must be at least 18 years old. Task Doers must be legally permitted to provide the services they offer. Users must not use Kwickly where prohibited by law or where their account has been suspended or terminated.

6. No Employment Relationship

Task Doers are independent providers. Nothing in these Terms creates an employment relationship, worker relationship, agency, partnership, franchise, joint venture or representative relationship between Kwickly and any Task Doer. Task Doers choose whether to accept tasks and are responsible for their own taxes, tools, insurance, licences, methods, invoicing and compliance.

7. Accounts and Security

Users must provide true, current and complete account information. Users must keep login credentials secure and are responsible for activity under their account. Fake, duplicate, misleading, fraudulent or impersonation accounts are prohibited.

8. Task Posting Rules

Task Posters must provide accurate task information, including title, description & details such as access details, safety details, category, location, urgency, fixed budget, and relevant photos. Task Posters must not post illegal, unsafe, discriminatory, misleading, abusive, exploitative or prohibited tasks which leads to permanent suspension of the account.

9. Urgency Levels

Kwickly may offer Urgent, Priority and Scheduled task types. Urgent means help is requested within approximately 2 hours. Priority means help is requested for today. Scheduled means help is requested for tomorrow or later. Urgency affects display, broadcast and prioritisation; it does not guarantee acceptance or completion time. Urgent tasks are vroadcasted to upto 21km considering the nature of urgency of the task to find closer help.

10. Broadcast and Acceptance

Kwickly may broadcast tasks to Task Doers based on category, distance, service radius, availability, profile settings, risk controls and platform rules. Task Doers may accept, reject or ignore task invitations. A task is confirmed only when the Task Poster selects or confirms a Task Doer and payment is authorised or completed.

11. Accepted Profiles

Where the app flow allows, Kwickly may show the Task Poster up to three Task Doer profiles that have accepted the task. The Task Poster may choose one of the displayed Task Doers or remove one or more displayed profiles from consideration. If a displayed profile is removed, Kwickly may show additional Task Doer profiles from the queue of Task Doers who accepted the task.

The Task Poster is responsible for choosing the Task Doer they wish to proceed withby checking the profile. Being displayed to the Task Poster, appearing in the acceptance queue, or being selected through the app does not guarantee the Task Doer’s skill, availability, legal authorisation, insurance, qualifications, safety, suitability, or service quality.

12. Budgets and Price Changes

Task Posters may set a fixed budget depending on the app flow. Task Doers must not accept a budget they do not intend to honour. Any price change, materials cost, extra time, travel fee or scope change must be agreed inside the app before the additional work or expense occurs.

13. Payments

Payments are processed through Stripe and/or Stripe Connect. Kwickly does not store card details. By using payment features, users agree to applicable Stripe terms. Task Posters authorise payment for confirmed tasks. Task Doers receive payouts through Stripe Connect subject to verification, KYC, account status, risk checks and Stripe processing timelines.

14. Platform Fees

Kwickly may charge platform commission, service fees, processing fees, urgency fees, cancellation fees, dispute-related costs or other disclosed fees. Fees will be shown before payment confirmation where applicable. Fees may vary by category, country, urgency, risk, task type, promotional period or user type.

15. No Off-Platform Payment

Users must not use Kwickly to meet each other and then complete payment outside the platform to avoid Kwickly fees. Prohibited payment methods for Kwickly tasks include cash, bank transfer, MB WAY, Revolut, PayPal, crypto, direct invoice outside the app or any other off-platform payment method.

16. Payouts to Task Doers

Payouts may be delayed, reduced, reversed due to Stripe restrictions, incomplete verification, suspected fraud, chargebacks, refunds, disputes, safety reports, account restrictions, legal obligations, negative balances or breach of these Terms. Kwickly may deduct platform fees, refunds, chargebacks, negative balances and adjustments from future payouts.

17. Cancellations

Cancellation rules may depend on urgency, time before task start, travel, preparation, materials, whether work has started and the reason for cancellation. Kwickly may apply cancellation fees where a cancellation causes reasonable loss, travel, preparation or disruption. Repeated cancellations may affect account status or task access.

18. Refunds

Refunds may be considered if the Task Doer does not attend, materially fails to complete the task, the task was significantly misrepresented, the Task Poster cancels within a permitted window, or Kwickly determines that a refund is fair based on evidence. Refunds may be denied or reduced where the Task Poster changes their mind after work starts, provides inaccurate information, prevents completion, or the Task Doer substantially completed the agreed task.

19. Task Completion

A task may be marked completed by Task Poster confirmation, Task Doer confirmation, automatic completion after a defined period or admin review. Task Doers must not mark tasks completed before substantial completion. Task Posters must report issues promptly through the app.

20. Disputes

If a dispute arises, users should first try to resolve it through the app. Kwickly may review task details, chat, photos, timestamps, status updates, location/status data, payment records, user history and evidence submitted. Kwickly may release payment, issue full or partial refund, release full or partial payout, restrict an account or request more evidence. Kwickly is not a court, arbitrator, regulator, legal adviser, accountant, tax adviser, insurance provider, or insurer.

21. Consumer Rights

Where a Task Poster is a consumer and a Task Doer is acting professionally, Portuguese and EU consumer rules may apply to the direct service contract, including rules on distance contracts under Decreto-Lei n.º 24/2014 where applicable. Task Doers acting professionally are responsible for required pre-contract information, withdrawal rights, invoices, receipts, complaint mechanisms and consumer obligations. Nothing in these Terms removes mandatory consumer rights.

22. Right of Withdrawal for Services

Where withdrawal rights apply, a consumer may lose or limit withdrawal rights when service performance begins or is completed with the consumer’s prior express request and acknowledgement, or where an exception applies by law. For urgent or same-day services, Kwickly may require a checkout acknowledgement that the user requests immediate performance and understands the possible impact on withdrawal rights.

23. Invoicing and Taxes

Task Doers are responsible for issuing invoices, receipts or legally required payment documents directly to Task Posters where required by law. Task Doers are responsible for declaring income, VAT, social security, accounting, registrations and tax obligations. Kwickly payment confirmations do not replace invoices required from Task Doers.

24. Professional Responsibility

Task Doers are solely responsible for legal authorisation, professional licences, registrations, permits, qualifications, certifications, insurance, safety standards, equipment, tools, tax compliance, invoicing and service quality. Task Doers must not accept tasks they are not authorised, qualified, insured or competent to perform.

25. Restricted and Prohibited Tasks

Users must not post or accept tasks involving illegal activities, medical treatment, passenger transport requiring authorisation, weapons, drugs, fraud, money laundering, adult services, surveillance, harassment, academic cheating, identity document misuse, banking/tax/government credentials, dangerous work or any service prohibited by law. Kwickly may remove tasks or accounts for legal or safety reasons.

26. Sensitive Information

Users must not request, upload or share unnecessary sensitive information through Kwickly, including passports, residence cards, tax portal credentials, banking credentials, medical records, passwords, government login details, private legal documents or highly sensitive personal information. Kwickly may block or remove such content.

27. Trust, Verification and Badges

Kwickly may offer email verification, phone verification, identity verification, optional Verified Client status, Task Doer verification, Stripe verification, freelancer or company document review, or portfolio uploads. Verification does not guarantee service quality, legal compliance, insurance, competence or behaviour.

28. Reviews and Ratings

Users may review each other after a task. Reviews must be honest, lawful, relevant and based on real experience. Fake, abusive, discriminatory, defamatory, paid, manipulated or privacy-invading reviews are prohibited. Kwickly may remove or restrict reviews that breach these Terms or law.

29. Digital Services Act and Content Moderation

Users must not upload illegal content or use Kwickly for illegal services. Kwickly may provide reporting tools and may review, remove, restrict, demote, suspend or disable content or accounts. Where legally required, Kwickly may provide explanations for certain moderation decisions and allow users to challenge platform decisions.

30. Messaging and Calls

Users may communicate through in-app chat and call features where available. Users must not use messaging to harass, threaten, spam, share illegal content, request prohibited services, bypass payments, exchange contact details to avoid fees, or share unnecessary sensitive data. Kwickly may moderate messages for safety, fraud prevention, disputes and enforcement.

31. Location and Tracking

Kwickly may use location data to match users, display distance, support service radius, enable active task tracking, estimate arrival, improve safety, prevent fraud and review disputes. Users may manage device permissions, but some features may not work without location access.

32. User Content

Users confirm they have the right to upload content such as task descriptions, photos, documents, profile content, portfolio materials, reviews and messages. Users must not upload illegal, infringing, misleading, abusive, discriminatory, private, adult, violent or unsafe content. Kwickly may remove or restrict such content.

33. Complaints and ADR

Users may contact Kwickly support at [SUPPORT EMAIL]. Where legally applicable, Kwickly may provide access to Livro de Reclamações Eletrónico. Consumer users may also use alternative dispute resolution mechanisms under Lei n.º 144/2015. Where the dispute concerns the actual service performed by an independent professional Task Doer, that Task Doer may be the relevant service provider responsible for consumer dispute obligations.

34. Suspension and Termination

Kwickly may suspend, restrict or terminate accounts for fraud, fake accounts, unsafe behaviour, abuse, harassment, discrimination, non-payment, chargebacks, repeated cancellations, false documents, platform circumvention, illegal content, prohibited services, legal risk, regulatory risk or breach of these Terms. Users may request account closure by contacting Kwickly.

35. Liability

To the maximum extent permitted by law, Kwickly is not liable for user conduct, Task Doer work quality, Task Poster behaviour, damage caused by users, late arrival, failed services, unsafe conditions, lost profits, indirect loss, tax or invoicing failures by Task Doers, professional advice given by Task Doers, Stripe restrictions, payment failures or thirdparty outages. Nothing in these Terms excludes liability that cannot legally be excluded.

36. Changes to Terms

Kwickly may update these Terms from time to time. Material changes may be notified through the app, website or email. Continued use after changes means acceptance of the updated Terms.

37. Governing Law

These Terms are governed by Portuguese law. Where legally permitted, disputes relating to these Terms shall be subject to the competent courts of Portugal. Consumers may benefit from mandatory consumer-protection rules in their country of residence where applicable.
